CANCELLATION POLICY

This Cancellation Policy applies to Subaka digital members only content, pre launch access, paid member access, recurring subscriptions, one time digital access, documentary archive access, audio archive access and related digital services offered through https://www.subaka.com.
This policy explains when you can cancel, when a refund may apply, how immediate digital access affects cancellation rights and how Subaka handles European Union, EEA, United Kingdom and United States customers where applicable.
Subaka provides digital content, documentary material, archive access, members only pages, video content, audio material, written updates, field recording archive material and related online access. Some content may become available immediately after payment or account activation.
General cancellation principle
Subaka keeps cancellation terms clear before purchase. If a paid membership, subscription or digital access plan renews automatically, the renewal terms, price, billing frequency and cancellation method will be shown before payment where required.
A customer may cancel a recurring paid membership to stop future renewal. Cancellation does not automatically refund a period of access that has already started, unless required by applicable law or confirmed by Subaka in writing.
If a customer buys one time digital access instead of a recurring subscription, cancellation normally applies only before access has started, unless applicable law gives the customer another right.
European Union, EEA and United Kingdom customers
If you are a consumer in the European Union, the EEA or the United Kingdom, you may normally have a statutory right to withdraw from an online purchase within 14 days without giving a reason.
For digital content that is not supplied on a physical carrier, this right may end once access begins, but only where permitted by law and only if you have clearly requested immediate access and acknowledged that you may lose your statutory right of withdrawal once access starts.
If you request immediate access to Subaka digital members only content, archive material, documentary chapters, audio material, streamed content, digital downloads or protected online material, you agree that Subaka may start providing access before the 14 day withdrawal period has ended.
Once access to that digital content has started, your statutory right of withdrawal may end where permitted by law.
United States customers
For customers in the United States, cancellation and refund rights may depend on federal consumer protection rules, applicable state law, the type of purchase, the subscription structure, platform rules and the terms shown at checkout.
Subaka does not promise a general 14 day refund period for United States customers unless that right is required by applicable law or clearly stated at the time of purchase.
If Subaka offers an automatically renewing subscription to United States customers, Subaka will aim to disclose the renewal terms, billing frequency, price, cancellation method and any material subscription terms before purchase.
If required by applicable United States law, Subaka will obtain the customer’s consent to recurring charges, provide confirmation of the subscription terms and offer a reasonable cancellation method.
For customers in states that require online cancellation for online subscriptions, Subaka will provide an online cancellation method where legally required.
Cancellation of a United States recurring subscription stops future renewal. It does not automatically refund charges for a current billing period, already delivered digital access or already started members only access, unless required by applicable law or confirmed by Subaka in writing.
Immediate digital access
If you request immediate access to Subaka digital content, Subaka may begin providing access before any statutory withdrawal or cancellation period has expired.
This applies to digital members only content, archive pages, documentary chapters, video material, audio material, full spectrum audio archive material, protected written content, digital downloads, streamed content and other online member material.
When immediate access starts, refund rights may be limited or lost where permitted by applicable law.
Required consent before immediate access
Before immediate digital access is provided, Subaka may ask you to confirm the following consent.

I request immediate access to the digital members only content before the end of any applicable withdrawal or cancellation period. I understand that once access begins, I may lose my statutory right of withdrawal or refund for that digital content, where permitted by applicable law.
If this consent is not given, Subaka may delay access until the applicable withdrawal period has ended or may refuse immediate digital access.
Cancellation of paid membership
You may cancel a paid membership through the cancellation option in your account, through the cancellation link if provided or by contacting Subaka at information@subaka.com.
Cancellation stops future renewal where a recurring subscription is active.
If your membership is for a fixed access period, cancellation may stop future renewal but does not automatically end or refund the current access period.
If you cancel after immediate digital access has started, Subaka may refuse a refund where permitted by applicable law.
Pre launch access
Pre launch registration and newsletter subscription are free unless clearly stated otherwise.
You can unsubscribe from the newsletter at any time.
Pre launch registration does not create a paid membership, does not guarantee future access and does not create a right to protected archive material.
Refunds
Refunds may be available where required by applicable law, where access has not yet started, where Subaka has not delivered the purchased digital access or where Subaka confirms a refund in writing.
Refunds are normally not available after immediate digital access has started and the customer has given the required consent and acknowledgement, unless required by applicable law.
If a technical problem prevents access, Subaka may first try to restore access, correct the account issue, resend access details or provide another reasonable solution before issuing a refund.
If Subaka cannot provide the purchased access within a reasonable time, a refund may be considered.
Chargebacks and payment disputes
If you believe a payment was made in error, contact Subaka first at information@subaka.com so the issue can be reviewed.
If a chargeback or payment dispute is opened, Subaka may suspend access while the payment issue is being reviewed.
Fraudulent payment activity, payment abuse or unauthorized account use may lead to account suspension or termination.
Abuse, misuse or breach of terms
Subaka may suspend or terminate access if a user breaches the Terms and Conditions, misuses protected content, shares members only material without permission, attempts unauthorized access, publishes sensitive archive material, exposes protected people, violates privacy rules, interferes with the platform or uses the service in an unsafe or unlawful way.
In such cases, refunds may be refused where permitted by applicable law.

Changes to this policy
Subaka may update this Cancellation Policy when the website, membership structure, payment system, legal requirements, state law requirements, digital access model or service structure changes.
